1. Introduction
Welcome to the DeSantis Family Charitable Foundation (“Foundation,” “we,” “us,” or “our”). The Foundation is a registered 501(c)(3) nonprofit organization based at 183 New Dorp Lane, Staten Island, NY 10306. Our mission is to support and improve the lives of children with special needs within the Staten Island community.
By accessing our website, making a donation, applying for a grant, volunteering, or participating in any of our programs, you agree to abide by these Terms & Conditions.
2. Eligibility & Use of Services
The Foundation’s programs, grants, and services are available only to eligible individuals and organizations that align with our mission. Users must be at least 18 years of age to donate, apply for grants, or register as a volunteer. Any misuse of our services or fraudulent activity may result in suspension or termination of access.
3. Donations & Tax Deductibility
The Foundation is a 501(c)(3) tax-exempt organization, and donations are tax-deductible as allowed by law. All donations are voluntary, non-refundable, and subject to our acceptance. Donors should consult their own tax, legal, or financial advisors for guidance regarding tax deductibility. The Foundation reserves the right to refuse any donation that does not align with our mission or legal requirements.
4. Grant Applications & Assistance
Grants and assistance are provided at the sole discretion of the Foundation.
All applicants must accurately complete our grant application form and provide any required documentation. Submission of an application does not guarantee approval, and funding decisions are final. Funds or resources granted must be used exclusively for their intended purpose.
5. Volunteer Participation
Volunteers agree to follow all Foundation policies, guidelines, and instructions while participating in events or programs. The Foundation is not liable for any injuries, accidents, or damages that occur during volunteer activities. Volunteers are expected to act responsibly, respectfully, and in line with the Foundation’s mission.
6. Event Participation & Liability
By attending or participating in any Foundation-sponsored event, individuals acknowledge that they do so at their own risk. The Foundation is not responsible for any loss, injury, or damages incurred at events. Photos, videos, or other media captured at events may be used by the Foundation for promotional purposes unless otherwise requested in writing.
7. Privacy Policy & Data Protection
The Foundation respects donor, volunteer, and beneficiary privacy and does not sell or share personal information with third parties, except as required by law. By using our website or submitting an application, you consent to our data collection and usage practices as outlined in our Privacy Policy.
8. Intellectual Property
All content on our website, including logos, images, text, and materials, is owned by or licensed to the Foundation. Unauthorized use, reproduction, or distribution of our materials is strictly prohibited.
9. Legal Compliance & Governing Law
The Foundation operates in compliance with all applicable federal, New York State, and local laws. Any disputes arising from these Terms & Conditions shall be governed by the laws of the State of New York, and legal actions must be brought in a court of competent jurisdiction within Staten Island, NY.
10. Amendments & Changes
The Foundation reserves the right to modify these Terms & Conditions at any time.
Any changes will be posted on our website and will take effect immediately.
